Is a Last Will and Testament needed, if one has a Trust?

August 8, 2017

Yes, the Trust and Will each have different purposes. Both provide for distribution; however, only a will can appoint an executor and designate a guardian for your children. Even if one has a Trust, a Last Will and Testament is needed to 'pour over' or catch any assets remaining in your estate (that have not been previously transferred to the trust) into your trust and subject to the trust distribution plan.
