Most Asked Questions

9) Is a Last Will and Testament needed, if one has a Trust?

Yes, the Trust and Will, each, have different purposes. Both provide for distribution; however, only a will can appoint an executor and designate a guardian for your children. Even if one has a Trust, a Last Will and Testament is needed to 'pour over' or catch any assets remaining in your estate (that have not been previously transferred to the trust) into your trust and subject to the trust distribution plan.
